Privacy & Data Protection Policy
Our policy for protecting your personal data is designed to build a relationship of trust between you and our services, and to give you a positive, fully transparent experience.
To honour that trust, Louzina Ltd (trading as Eavenest) guarantees, as a matter of priority, the protection of your personal data and the confidentiality of our customers ("Your Data").
For full transparency, and to ensure secure use of our website www.eavenest.com in all its versions and related applications (the "Site"), we set out how we process Your Data so that our services always respect your rights. We take all necessary precautions to protect Your Data against disclosure, loss or alteration. Your Data is retained only for as long as necessary for the defined management and processing purposes. You can access and modify your data at any time via your personal account on the Site.
We take all necessary steps to comply with applicable data protection law. Accordingly, Louzina Ltd undertakes to respect the essential principles of the UK GDPR and the Data Protection Act 2018, by providing you with information about the existence and terms of the processing carried out (section 3), the rights you hold over your data (sections 6 and 10), information about any transfers to third countries or recipients, the retention period of the data collected (section 5), and the security measures in place (section 9).
1. WHO ARE YOU?
When we refer to "you" in this policy, it is because it directly concerns you as a customer of Eavenest (if you have placed an order), as a registered account holder who has not yet ordered, or as a visitor who has browsed the Site without creating an account or placing an order.
2. FOR WHAT PURPOSES DO WE PROCESS YOUR DATA?
3.1. When do we collect your personal data?
Your personal data may be collected when you visit the Site using cookies, create an account, place an order for one of our products or services, or agree to receive our newsletters (SMS, email).
Your personal data helps us make your browsing smoother and offer a more personalised experience. It allows us to process your orders, offer instalment payment where available, prevent fraud, make refunds, and manage your customer reviews.
3.2. Your browsing on the Site
To enable your browsing on the Site, we process your data on the legal basis of your consent.
3.3. Processing your orders
To handle and process your orders, we use your data. We use it to manage complaint resolution, customer relations (including via social media), our after-sales and distance-selling service, our marketing and commercial prospecting for the Site, and the management, delivery and transport of orders.
The legal basis for this processing is the performance of the contract between you and us. Where we manage product recalls, the legal basis is our legal obligation. For marketing and commercial prospecting, the legal basis is either your consent or our legitimate interest, depending on the case. For "flash" payment, the legal basis is your consent.
3.4. Instalment payment
For orders eligible for instalment payment, and for certain customers, your data is processed to offer this payment type. The legal basis is the performance of the contract; however, your consent remains the basis for processing your payment data.
3.4.1. Klarna
To offer you Klarna's payment options, we may transmit to Klarna your personal data, including your contact details and order details, so that Klarna can assess your eligibility and tailor those options to your needs. The data transferred will be processed in accordance with Klarna's privacy policy.
3.5. Customer reviews
To share your reviews with our customers and visitors, and to allow you to leave a review on the Site, we use your data on the legal basis of your consent or legitimate interest.
3.6. Payment recovery and fraud prevention
To enable payment recovery and fraud prevention, and to ensure payment security, we use your data. The legal bases are the performance of the contract and the legitimate interest of Louzina Ltd as data controller.
3.7. Advertising operations
Our advertising operations are managed using your data. This allows us to grow our customer and prospect base, manage technical activities, produce commercial statistics and advertising-campaign studies, and run our competitions, prize draws or other promotional operations. The legal bases are the user's consent or the legitimate interest of Louzina Ltd.
4. WHERE DOES YOUR DATA GO?
Your data is shared with several internal services of Louzina Ltd. It is not sent to third parties, except in the situations described below.
To process your orders, your personal data may be shared with several providers specialising in banking transactions, customer relations, after-sales service, delivery, IT development, site management, or the provision of warranties or insurance.
For instalment payment, your data may be shared with providers such as payment and transaction centres (banks, etc.) or call centres for business-process or customer-experience management, and, for customer reviews, with a reviews-management provider. Our advertising operations are managed using your data with advertising partners and advertisers.
5. DATA RETENTION
The data Louzina Ltd collects is retained only for the time necessary to carry out the operations set out in section 3.
We retain certain data as follows: prospect data is kept for 3 years from the last contact with the customer. Order-related data is kept for the period necessary to fulfil the order and thereafter to meet our legal, accounting and tax obligations (in the UK, business and accounting records are generally kept for 6 years). Payment-card data is retained only for the validity period of the card (plus one day); no intermediate archiving of card data is carried out.
Cookies, their use and their duration are detailed in section 7.
6. EXERCISING YOUR RIGHTS
Under the UK GDPR, you have the following rights:
6.1. The right to request access to, and rectification of, Your Data.
6.2. The right to request restriction of the processing of Your Data — for example, where you contest the accuracy of your data for the time needed to verify it; where you consider the processing unlawful but request restriction rather than erasure; where we no longer need the data but you need it for the establishment, exercise or defence of legal claims; or where you have objected to processing pending verification of whether our legitimate grounds override yours.
6.3. The right to request erasure of Your Data. Where you request erasure, Louzina Ltd may nonetheless retain your data in an intermediate archive for the time necessary to meet its legal, accounting and tax obligations.
6.4. The right to object to processing carried out for commercial prospecting purposes. For email marketing, you may unsubscribe by clicking the "unsubscribe" link in any newsletter, or via the contact page. For SMS marketing, you may unsubscribe by replying STOP to any message, or via the contact page.
6.5. [Removed — see note below.]
6.6. The right to data portability.
6.7. The right to withdraw your consent for processing based on that legal basis. Please note: withdrawing consent does not affect the lawfulness of processing carried out before the withdrawal.
6.8. The right to lodge a complaint at any time with the competent supervisory authority. In the UK, this is the Information Commissioner's Office (ICO), www.ico.org.uk.
To exercise your rights, please send your request (together with your email, first name, surname and postal address) to Louzina Ltd by email at contact@eavenest.com. We may ask you to verify your identity. We will respond within one (1) month of receiving your request.
7. COOKIES
7.1. What is a cookie?
When you browse a website such as ours, it may — depending on your choice — place a small text file on your device (computer, phone or tablet) via your browser. This file is called a cookie. It allows the website to recognise your device during a later visit, for the cookie's validity period. Only the issuer of a cookie can read or modify the information it contains.
7.2. What are cookies used for on our Site?
Cookies can be grouped into categories. Some are issued directly by us and our providers; some come from third parties.
7.2.1. Cookies issued by us and our providers
7.2.1.1. "Essential" cookies — necessary to access and use the Site, for example to place an order. Without them, you may experience browsing problems and be unable to place an order. They also allow us to monitor our activity.
7.2.1.2. "Analytics and Personalisation" cookies — not mandatory; they help us facilitate your searches, optimise your experience, better target your expectations, tailor our offers and organise our Site.
7.2.1.3. "Advertising" cookies — displayed in the advertising areas of our Site. They aim to present offers and adverts relevant to you, based on your recent browsing history on other sites, to avoid showing you irrelevant advertising content. They may be issued by us, our providers, or third parties.
7.2.2. Cookies issued by third parties
Third parties using cookies on our Site apply their own privacy policies. These cookies are not necessary to use our Site.
7.2.3. Cookies from third-party applications integrated into our Site
While browsing, we may include third-party applications allowing you to share content and/or your opinion (for example, social-media "share" or "like" buttons). Through these buttons, social networks may identify you even if you did not use them, if you were simultaneously logged in to them. We have no control over their use of, or access to, this data. To learn more, please consult the privacy policies of the relevant social networks and adjust your settings there.
7.3. Managing cookies through your browser and consent banner
You can accept or refuse non-essential cookies through the consent banner presented on the Site, and change your preferences at any time. Your browser also offers options to accept, refuse or delete cookies; you can usually find these in your browser's help menu. Refusing certain cookies may alter your browsing experience or your ability to use some services (such as placing an order). Where you refuse or delete cookies needed for our services to function, we accept no responsibility for any resulting disruption.
8. TRANSFERS OUTSIDE THE UNITED KINGDOM
Most of the time, your data is stored within the United Kingdom or the European Economic Area. However, where our providers are located outside the UK, we may share some of your data with third countries, including countries not covered by a UK "adequacy" decision.
In that case, we take the necessary steps to ensure such transfers comply with applicable regulation and that your privacy and fundamental rights are protected — for example, by using an International Data Transfer Agreement (IDTA) or the UK Addendum to the EU standard contractual clauses. On request, we can provide further information about these transfers.
9. SECURITY MEASURES
Through the technical and organisational measures we take, we ensure a level of security appropriate to the risks to the rights and freedoms of individuals. We take into account the origin, scope, context, cost and state of the art, the purposes of processing, and the identified risks. We also comply with the PCI-DSS payment-card security standard, reflecting our commitment to security.
10. PROFILING AND AUTOMATED DECISION-MAKING
We use certain automated processing (such as profiling), which may produce effects concerning you. This is necessary for the conclusion or performance of the contract between us — for example, automated customer identification and "instalment" payment. It is based on the analysis of variables relating to the type of products or services ordered and the customer profile. If the assessed risk is too high (fraud/non-payment), that payment option will not be offered. You may, however, request human intervention, express your point of view, and contest the automated decision.
11. UPDATES TO THIS POLICY
This policy will be updated whenever necessary to remain aligned with applicable data protection law, and in any event reviewed at least every three (3) years.
